UK Export Control Law Amendment Goes Effective

The Export Control (Military and Dual-Use Lists) (Amendment) Regulations 2023 of the US Export Control Laws went effective on the 31st of March.

These new regulations will amend the following:

  • Schedules 2 and 3 of the 2008 Order or the Export Control Order 2008
  • Annex I of the retained Council Regulation (EC) No 428/2009 of May 5, 2009

The amendments depict the transformation of the UK’s international export control commitment and aim to rectify the minuscule drafting errors and preferences. These amendments will result in the creation of a Community regime regulating the trading (export, transfer, broker, transit) of dual-use articles (Recast).

The following are the fundamental changes:

  • An amendment to implement the changes to the Wassenaar Arrangement munitions list as decided in December 2022.
  • Amendments to the Annexure I of the retained Dual-Use Regulations. These regulations list down the dual-use items, technology, and software subject to export controls. The amendments also implement changes to the- 1) dual-use list under Wassenaar Agreement and 2) controls lists under the multilateral export control regimes like Missile Technology Control Regime and Australia Group as decided in December 2021.
